Terms & Conditions

  1. BY ACCEPTING DELIVERY OF RENTED ITEMS, CUSTOMER AGREES TO ALL TERMS AND CONDITIONS SHOWN ON THIS RENTAL CONTRACT AND THE ATTACHED TERMS AND CONDITIONS IN THE EMAIL OF THE CONTRACT. CUSTOMER ACKNOWLEDGES THAT S/HE HAS, UPON ACCEPTANCE, RECEIVED IN GOOD ORDER ALL RENTED ITEMS AND OTHER GOODS LISTED ON THE CONTRACT.
  2. CUSTOMER ASSUMES FULL RESPONSIBILITY FOR ALL RENTED ITEMS, INCLUDING THEIR SAFE AND PROPER USE, OPERATION, MAINTENANCE, AND RETURN TO CHARM AND LUNA PARTY RENTALS. CUSTOMER IS RESPONSIBLE FOR ALL LOSS, DAMAGE, OR REPAIR.
  3. CUSTOMER AGREES TO USE EQUIPMENT SOLELY AT THE APPROVED LOCATION UNLESS OTHERWISE AGREED UPON IN WRITING.
  4. CUSTOMER IS PROHIBITED FROM LOANING OR SUBLEASING RENTAL ITEMS WITHOUT PRIOR APPROVAL.
  5. CUSTOMER IS REQUIRED TO SECURE AND PROTECT RENTAL ITEMS WHILE IN THEIR POSSESION.
  6. CUSTOMER AGREES TO PAY “LOSS OF USE” DURING THE REPLACEMENT PERIOD OF BROKEN OR MISSING ITEMS.
  7. CHARM AND LUNA PARTY RENTALS MAKES NO WARRANTIES OF MERCHANABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES, EXPRESSED OR IMPLIED.
  8. THIS RENTAL CONTRACT FORMS THE SOLE AGREEMENT BETWEEN THE CUSTOMER AND CHARM AND LUNA PARTY RENTALS. THE CUSTOMER AGREES TO INDEMNIFY AND HOLD CHARM AND LUNA PARTY RENTALS HARMLESS FOR ANY CLAIMS FROM CUSTOMER USE OR MISUSE, INCLUDING ANY THIRD PARTIES FOR LOSS, INJURY, AND DAMAGE TO PERSONS OR PROPERTY ARISING OUT OF THE CUSTOMER'S NEGLIGENCE OR OPERATION, INCLUDING LEGAL COSTS INCURRED IN DEFENSE OF SUCH CLAIMS.
  9. CHARM AND LUNA PARTY RENTALS IS NOT RESPONSIBLE FOR RUST STAINS FROM RENTAL INVENTORY BEING LEFT OUTSIDE, WATER EXPOSURE, OR BURNS AND DAMAGE CAUSED BY SMOKING. RENTAL PROPERTY SHOULD BE MOVED OR PROTECTED BY CLIENT TO AVOID RUST, STAINS AND DAMAGE.
  10. RETAKING OF EQUIPMENT: IF CUSTOMER FAILS TO RETURN ALL RENTED ITEMS UPON AGREED TIME, CUSTOMER AGREES TO PAY FOR ALL ADDITIONAL CHARGES. IF CUSTOMER REFUSES TO RETURN RENTED ITEMS, THE CUSTOMER AGREES THAT CHARM AND LUNA PARTY RENTALS AND ITS AGENTS MAY TAKE ALL REASONABLE ACTIONS NECESSARY TO RECOVER RENTED ITEMS WITHOUT PRIOR NOTICE OR THROUGH THE LEGAL PROCESS.
  11. CUSTOMER ACKNOWLEDGES THE POSSIBILITY OF INJURY AND WILL PROVIDE ADULT SUPERVISION AT ALL TIMES ACCORDING TO THE RULES GIVEN TO RENTAL PARTY PRIOR TO EVENT, WRITTEN INSTRUCTION, OR VERBAL.
  12. ATTORNEY FEES: CUSTOMER AGREES TO PAY ALL REASONABLE ATTORNEY FEES AND COURT COSTS INCURRED BY CHARM AND LUNA PARTY RENTALS IN ENFORCING THESE TERMS AND CONDITIONS.
  13. NO CANCELATIONS ALLOWED ON DELIVERY OR WITHIN 48 HOURS BEFORE DELIVERY. YOU WILL BE CHARGED THE FULL RENTAL PRICE.
  14. ORDERS MUST BE FULLY PAID, AND CONTRACT EXECUTED TO ENSURE RENTAL ITEMS ARE RESERVED FOR THE EVENT DATE.
  15. ORDERS CANCELLED AFTER CONTRACT EXECUTION AND CONFIRMATION BUT BEFORE THE 48 HOUR DELIVERY DATE, WILL BE CHARGED A FEE 50% OF THE CONTRACT TOTAL, DUE TO LOST OPPORTUNITY COST.
  16. DELIVERY IS TO THE STREET LEVEL. AN ADDITIONAL FEE WILL BE CHARGED IF THE EQUIPMENT HAS TO BE CARRIED AN EXCESSIVE DISTANCE OR UP STAIRS.
  17. ALL RENTAL ITEMS NOT PREVIOUSLY ARRANGED TO BE SETUP BY CHARM AND LUNA PARTY RENTALS MUST BE RETURNED TO THEIR POINT OF DELIVERY. ALL TABLES AND CHAIRS MUST BE FOLDED AND STACKED. ALL CHAIRS DELIVERED ON PALLETS MUST BE STACKED ON SAID PALLETS. FAILURE TO COMPLY MAY RESULT IN AN ADDED DELIVERY CHARGE TO BE DETERMINED BASED ON THE SIZE OF THE ORDER.
  18. TERMS ARE SUBJECT TO CHANGE WITHOUT NOTICE.
  19. ALL CREDIT CARD TRANSACTION ARE SUBJECT TO 3% PROCESSING FEE.
  20. I AGREE TO CHARGE MY CREDIT CARD FOR THE REPLACEMENT COST OF ANY MISSING OR DAMAGED ITEMS AND ALL RENTAL CHARGES IF OTHER FORM OF PAYMENT (CHECK) IS RETURNED UNPAID. RETURN CHECK FEE IS $35.

Protective tips on platform, table and chair legs are NO guarantee against damage to floor surface. Charm and Luna Party Rentals will not be liable for damage to hardwood or any other surface caused by rented items. Tables and chairs must be stacked and returned to their point of delivery. The price for tables and chairs does NOT include setup unless specifically stated.

Do not allow candle wax to drip onto linens. Do not allow smoking damage to the linens. Linens must be dry and all trash shaken off before returning. Customer is responsible for moldy or damaged linens. Linens will be inspected for damages upon return to the warehouse.
